Time off under the Family Medical Leave Act is appropriate to take care of a child who has an out patient surgery. However, employees must meet certain criteria for the FMLA to apply.
The Family Medical Leave Act and the California version called the Family Care Rights Act applies to employees who work for companies with 50 or more employees in a 75 mile radius of the employee's work site. The employee must have worked 1,250 hours or more for the employer within the last year. The employee can take a maximum of 12 weeks under the CFRA and FMLA within a year's time.
