Downtown Los Angeles near the Los Angeles Superior Court. Today I argued a motion involving a claim my clients should be subject to arbitration in a meal break, rest break, off-the-clock, and overtime case. In a court class action the Defendant settled about 2,000 claims for workers who signed the same arbitration agreement as my clients. However, when there are only a few people bringing the same claims they want arbitration. Very inconsistent position. Court are not supposed to allow inconsistent utilizations of arbitration by employers.

I chanced upon this re-creation of a Camino Real bell outside the old's church in Los Angeles, part of the Pueblo (Olvera Street). This is where I have to park sometimes when I go to the Los Angeles court for class actions. Yesterday we got a complex ruling from a judge in a controlled standby lawsuit involving overtime, minimum wage, and whether an employee who is forced to live in an apartment of the employer should be paid for waiting to be called.

This day I was representing a woman on a sexual harassment case in which another woman sexually harassed her and said offensive things about her race. Beverly Hills, Los Angeles, and Century City are all the kinds of places where an employment defense lawyer might be. The employer generally only takes the employee's deposition. I take depositions of all sorts of people in order to get a record of evidence.

To the right of the Dorthy Chandler Pavilion is the Downtown Los Angeles Stanley Mosk Courthouse. To the right is City Hall which used to be the tallest building in Downtown Los Angeles. It was also the spot you would see Superman flying above on the old TV show from the late 1950s. It's been some long weeks of work lately in Downtown Los Angeles on the our employment law cases.

California employers of more than 50 employees are required to provide sexual harassment training to their supervisors. Rooms in law firms, as depicted in this photo, are often used for managerial training. Besides sexual harassment training managers should be trained on the difference between pregnancy disability and FMLA as well as workers compensation rights. Unfortunately many employers do not properly train their management. Untrained management may fire an employee illegally, or blow off sexual harassment. These circumstances lead to employee litigation.
