I travel to meet large groups of people for class actions. I don't mind the drive and the hotel conference room fees if the clients show up. But if all 6 of them stand me up after I've made custom questionnaires for them and paid for a room in Montebello that's plain rude. Well, at least this is the first time this has happened. I am back to my rule that if the clients can't drive an extra 10 miles out of their way they can find another contingency lawyer. If clients like this do show up they only show up once and are never heard from again. Too lazy for a lawsuit!

This is the inside of Central Civil West, the court house for complex cases including class actions. Today the court gave final approval on a class action settlement of mine in which the employees had to standby to work, but were not paid minimum wage for waiting for their employer to call them. The settlement was reached almost nine months ago. Hopefully the class of employees will receive their payments this year.

CLASS ACTION FOR WAGES VERSUS PAGA OR INDIVIDUAL EMPLOYEE LAWSUITS

Today the 9th Circuit Court of Appeals may have set the stage to outlaw the particularly foul concept an employee's ability to bring a class action is waived through an arbitration agreement which often does not specifically waive classwide arbitration, but is believed to do so through the molecules in the air. In Ernst & Young the 9th Circuit invalidated an arbitration agreement that waived the employee's concerted rights to bring a class action to recover overtime and adjudge their misclassifications. The United States Supreme Court has recently been known for overturning the 9th Circuit Court of Appeals, but many commentators believe this decision may stick if the Supreme Court vacancy is filled by Clinton. or even a moderate conservative. A few years ago when class waivers came into vogue I painfully watched a number of cases go the individual employee route. This year I arbitrated one for four plaintiffs, won, and resolved the matter before the PAGA action which has become a minor end run at class action waivers. My four clients were brave and missed a week of work for the arbitration, but many employees cannot do so in order to win wage claims of $2,000 to even $20,000. Employees need the ability to bring class claims so present employees can receive restitution without being fired, and claims of small value can receive adjudication.

EMPLOYEE CLASS ACTION LAWYER IN LOS ANGELES

The vast expanse of downtown Los Angeles from the California Center where I successfully mediated an
on-call class action today. I'd like to believe the success of the mediation was due to the strong merits of the case and the numerous unsolicited calls from class members that resulted in questionnaires and declarations filled out. However, the fact we had a strong mediator knowledgeable of this area of the law and respected by both myself and opposing counsel made a difference. Wage and hour class action settlements can be very technical. Today, the Superior Court in Bakersfield approved another on-call class action settlement of mine but indicated a few words in the proposed notice had to be changed. That judge took issue with something in Paragraph 13 of Exhibit 5 which as you can imagine was way into the papers. This is an example of a judge closely reading the settlement papers in order to properly approve a class action settlement and finding a small oversight both sides in the settlement overlooked.

prevailing wage class action mediation. This was one of those intense days where nobody ate until 2 and there wasn't time to go to the bathroom. Some cases can be very high strung and go on for more than ten hours in a day.

Vermont, heading North towards the 101 or even further North towards the Hollywood sign and the former site of the
Los Angeles Normal School aka UCLA. At one time if you turned left on Rosewood there was a building of a law firm I worked at in 1986 (my first job in a law office). Otherwise, this was my old route home from law school. Today it was my route up Vermont after going to the Central Civil West Courthouse, where class actions are heard, for the last time ever. Now that a Target and some expensive apartment is across the street from the facility, and the neighborhood is desirable after 50 years, the Central Civil West Courthouse is moving to the old Federal Court building on Spring Street in a little more than two weeks. I will miss coming to this part of town.
