

Why a sign you may ask? Without blowing up this picture beyond what you see here I cannot read the text under the various colors. In order to read the text in the middle of the sign I have to further enlarge the picture. Enlarging the picture, or having the right glasses is a mitigating measure. While my eye sight is not perfect I certainly would not qualify as being disabled because of my eye sight. Others with worst vision, or non-correctable vision might.
If mitigating measures are needed for somebody to perform daily life activities, or to work they may qualify under the Fair Employment and Housing Act as being disabled. There are, however, limits. People who have a mild eye glass prescription (a mitigating measure) at 47 year of age are not likely to qualify as disabled.
Knowing one's diagnosis is important in being able to communicate with an ADA lawyer to determine if you have a disability the law provides accomodation for.

Still at Judicate West in downtown Los Angeles. Today is a case for disability discrimination against the same employer as yesterday who engaged in both pregnancy and disability discrimination. It seems to me this employer needs local human resources able to effectively engage in interactive processes. Moreover, they cannot have a policy of never allowing employees to work with restrictions just because their workers are in a warehouse. This particular client drove a truck back and forth. She did not need to lift excess weight.

This is the courtyard of the Museum of Tolerance in West Los Angeles.
There is a wonderful lobby exhibit right now at the Museum of Tolerance. A former fashion photographer (Rick Guidotti) has made it his mission to photograph PEOPLE with disabilities rather than their disabilities. The exhibit is called On Beauty. I was privileged to see the opening of this exhibit today, and watch the 30 minute short film that accompanies this ongoing project.
Mr. Guidotti's project has solidified my reasons for vigorously defending the rights of disabled workers. One of the purposes of Guidotti's work is to broaden public awareness of disability and difference. I am finding it unfortunate in the modern age of the workforce, in which many persons suffer from disabilities, employers are exceptionally hostile towards permanent accomodations for disability. There is one jury trial (only) in my career that I lost and it involved a jury panel who did not believe Los Angeles' bus system (the wonderful MTA) had a duty to accomodate an ongoing disability that would never go away.
