
I have always liked the building on the left and its house like characteristics at the top. The Ernest & Young Plaza to the right I have always hated. There is a lovely walk from the elevator which involves stairs before entering the building which has its own elevators. Brilliant design for those of us who have to carry things or have disabilities! It is also fun to dodge the rain or 100 degree heat on the quarter mile plus hike. I am sure it's also loved by all the workers who already have quite some time tacked onto their daily commute.

This is LA; at least the 405 North and Westwood on the other side. The Employment Lawyers Group fights law firms in this region, Century City, Downtown Los Angeles, the San Fernando Valley, the South Bay, and the Glendale/Pasadena Area. When we are not in Los Angeles County we are in Bakersfield, Orange County, Oxnard, Riverside, or San Diego. Lawyers must beware of agreeing to accept service by email. The things that can go wrong include:

Most email systems spam files with multiple attachments, or large attachments from first time senders.

Email is often picked up from multiple locations other than the office including cell phones, home computers, or laptops while on a case. It is very easy to forget an email was sent if it is picked up from a location away from one's desk, secretary, and calendar.

Do you really have a completely electronic office, and is your staff truly proficient in the updating, categorizing, and finding electronic files? If not, you have set yourself up for a massive printing and tabbing exercise if you accept service by email.

Email opens you up for fights, misunderstandings, and instant access 24 hours a day. Do you really want that? I have been repeatedly emailed in a harassing manner at a funeral by a lawyer who knew I didn't want the instantaneous cc's because I was at a funeral. During the delivery of my youngest son I received at least ten emails from a lawyer I did not know well.
The dignity and importance of legal filings as well as due process under the law are inconsistent concepts with email service. If email service is going to be used on a case, a portal such as Case Anywhere should be used. Subscription costs are $135.00 a quarter, per case. These services are useful for class actions, but too expensive for general civil litigation. Portals like Case Anywhere and the Federal Court's system send you an email saying you have been served. You will know an email from the portal means you were served. Moreover, the document will exist on the portal opposed to an email server which might send the document to a spam folder and be deleted in a week or two if you do not know to rescue it. Beware because even if some of your associates or support staff can keep up with electronic service I bet a lot of them cannot. From a West Los Angeles mediation today on Wilshire Boulevard. The power in the building went off. My client witnesses a lightning bolt strike a transformer outside. We continued to mediate, in the dark, for about two hours. Although much meaning could be read into these statements, nothing hidden is intended. This is how some days go for me when I am representing healthcare whistleblowers, or just doing my job. Last month, in the rain, I drove over the Grapevine to a mediation for four sexual harassment clients. I had a fever above 100. The case settled for $610,000. On the way back, around 10 PM, I made it through ice on the grapevine. Some employee lawyers take their responsibilities to their clients seriously. I guess I am one of them.

This week we added an additional attorney to our employment law practice. She has jumped into the thorough discovery on some of our California whistle blower lawsuits. Although case results almost always occur outside of the office every employee lawsuit is filled with questions (interrogatories) and document demands from our side and the employer's. It is important to ask the right questions, ask for the right documents, and provide the right documents. Failing to discover (obtain) the right information puts the employee at an evidentiary disadvantage. It is interesting for me to see attorneys new to my practice work on these cases.
