After representing hundreds of women who were sexually harassed I have formed two opinions: 1) Sexual harassment is often about power; 2) Sexual harassers know how to find their victims. They generally find victims who have been molested as children, are afraid to complain to management about the sexual harassment, and take the harassers' threats of retaliation literally. Don't be a victim! Stand up for your rights and do not be ashamed to be explicit in complaining in writing about each form of harassment, no matter how terrible it is, to management. Words of wisdom from a lawyer licensed in California, Texas, Massachusetts, and Washington D.C.

One of the debaters in the first round I judged was the son of an employment defense lawyer I have opposed since the 1990s. Next, he ended up being the judge on a team my son was on. Overall, a fine crop of future lawyers who could end up applying for work in 12-13 years.

Century City in Uptown Los Angeles. On my way to the second day of a male-on-male sexual harassment arbitration at ADR Services, Inc. today.

As of October of 2014 there were 133,400 legal jobs in the State of California. December 6, 2014 The Los Angeles Times reported there are 250,000 lawyers in California, and these numbers have been flat. These statistics are interesting for two reasons: 1) There must be many inactive lawyers because the legal profession statistics from the EDD (133,400 jobs) include non-lawyers; 2) There is not any growth in the California legal profession. This news, coupled with news of a decline in bar passage rates in California presents the unfortunate conclusion that perhaps spending in excess of $150,000 to become a lawyer is not a good investment. BTW, $150,000 would barely cover the tuition and real and digital books for an ABA accredited law education today. Flip side, being a lawyer is a wonderful and noble profession notwithstanding its high rates of alcoholism and depression. My personal take, I incurred $80,000 in law school debt in the early 1990s, paid it off within four years of graduating, and would not trade my bar card for anything!

Here is a quote from a 1996 California appellate case on prevailing wages I came across while prepared to speak at a seminar. Here, in 1996 the 2nd Appellate District directly denigrates my first residence which of course was demolished: "The Mar Vista project involves demolishing 647 deteriorated 40–year–old units on UC land near, but not on, the UCLA campus, and replacing them *584 with 912 new units and related facilities, including a 170–person child care facility, and greater security. Like the Westchester Bluffs project, no direct or indirect state appropriated funds are being used to finance the project. " Actually, I was always led to believe these "Married student housing units" were dilapidated during my rein from 1969-1971. At least the pictures my parents took of me had that effect.

This week the Supreme Court made two rulings in the area of employment discrimination that are very important. However, employment cases using Federal Law are diffrent than employment lawsuits in which California employment laws are used. Whenever possible, for my California employment law clients, I use Caifornia state employment laws under the Fair Employment and Housing Act. While retaliation may now be a higher standard in Federal discrimination cases, the standard is not as high in employment cases that make use of California state employment laws. If you happened to read about Vance v. Ball State University, its logic does not at this time apply if you have a discrimination lawsuit based on California State discrimination law. Nor do any U.S. heightened standards for proving who a supervisor is in a harassment case. California has its own statutory definition of what a supervisor is for the purpose of sexual harassment and harassment based upon other discrimination laws such as race harassment. If you would like to talk to me about the various standards for winning employment discrimination cases, I and my associate attorneys are available at +1 (323) 525-1600

When an employer wishes to fire their employee in the state of California, they can do so at any time and for almost any reason. They may do so for a reason that is not viewed as fair, but a terminated worker may have nothing that they can do about it. Fortunately the law does step in during certain situations and penalizes employers that are believed to have terminated the worker for an illegal reason. It is a violation of the law to fire those that are involved in a whistleblower case, as well as for any reasons of discrimination. You can read more on our firm's blog or call our office directly and set up an appointment. https://worklawyerca.com/category/blog/

One of the most disgusting stories to emanate from the Los Angeles area, as late as 1958, concerns a woman who was denied the opportunity to ride in the Pasadena Rose Parade in 1958 when it was discovered she was actually, image all things, Black! Next, her friends whom were municipal employees stopped speaking to her. In recent interviews Joan Williams mentioned this was the first time her came to understand what racism was. As a youngster, these sort of tales about race discrimination motivated me during law school to pledge to myself I would use my law license to fight discrimination. By the early 1990s, the most prevalent examples of discrimination had moved into the workplace. Today, at 82 Joan Williams got an apology from the Mayor of Pasadena and rode on a Rose Parade float.

This picture represents employment discrimination's undertone of dark murk, and the occluded ability to predict the trial outcome of an employee lawsuit. In the study of cultural history one method of dating pictures and postcards is to date the vehicles in the picture. Some years back I picked up this rare postcard of UCLA at a vintage postcard convention. It doesn't have a suggested amount for a stamp, or any indication when the picture was taken. The number 37 can be seen on the bottom. I need your help! If you look closely there are a number of parked vehicles above the field. What are the years of these cars? After we make the deduction what years the cars are we then have to ask what would be the typical age of a UCLA student's car during this period? Don't assume this was taken in 1937. So if somebody is telling you that you spend too much time looking at cars tell them these skills are needed for archeological purposes.

Yes, this is actually a real picture; not an image of what a 70s building will look like once built. This is Los Angeles Superior Court, Central Civil West known to Los Angeles lawyers as CCW. It used to be reserved for long cause trials over three weeks. These days it is primarily a courthouse for class actions. Technically, any complex litigation can land in CCW. Complex is usually defined as many parties. Central Civil West's building was completed in 1972. It is 19 floors and is 78.33 meters high. It houses other Los Angeles County operations. It was originally called the CNA building. In 1972 many insurance companies were still in this area. I appeared in the CCW court today on a class action. The California Judicial Council ordered a hearing be held to determine if my prevailing wage class action should be coordinated with an earlier filed class action. CCW is located in what is now known as Koreatown. This area used to be known as Mid-Wilshire or Westlake (now MacArthur Park, a place primarily to buy fake IDS). The Los Angeles complex courthouse is located close to where I went to law school.

The doors to justice; at least for those who might have a case in Department 39 of the downtown Los Angeles Superior Court for civil cases. All of the courthouse doors inside of the 1958 courtroom look like this. Some claim the Stanley Mosk courthouse has the best jury pool in the world. I spent my morning in this courthouse building on an employee breach of contract case.

We have finally moved into fall in Southern California. As the year draws to a near, I am sure employers are thinking about who they will be laying off. Will they layoff those on medical leave? Will those over 40 be fired due to their age? It is amazing how many employers are back to the old, "Layoff" defense. Below is a picture to cheer you up and remind you on summertime wage violations.

You can see the tallest building in Los Angeles starting to eclipse several highrises as its construction continues. Taken from a failed pregnancy discrimination mediation today. Sometimes employers have unrealistic views about case value. Because I tried and won three pregnancy discrimination jury trials and an arbitration, as of late, I know the value of pregnancy discrimination lawsuits.
